*K&H’s 2006 FREE EXTREME WINDOWS MAKEOVER SWEEPSTAKES OFFICIAL RULES

CONSUMER DISCLOSURE

1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
2. Entry into this promotion means you are acknowledging an interest in the products and services provided by K&H Windows and Exteriors (K&H), and are agreeing to be contacted by phone at some time in the future by K&H to discuss your interests.
3. You may enter the sweepstakes in the following ways:
   1. to enter online, fill out the above form and submit it to K&H.
   2. all individuals who purchase products from K&H during 2006 and who meet all other eligibility requirements are automatically entered into the sweepstakes.
   3. all individuals who schedule and keep an appointment, with no obligation to purchase anything, to hear about K&H’s windows and who meet all other eligibility requirements are automatically entered into the sweepstakes.
   4. all individuals who fill out an entry form at the office of K&H or any show booth or kiosk sponsored by K&H and who meet all other eligibility requirements are entered into the sweepstakes.
4. The grand prize (which is the only prize) shall be the provision and normal installation of up to ten (10) CONTOUR (or at K&H’s discretion, comparable replacement windows), with a then-current advertised price per K&H’s price list of up to $6,000, installed at the address listed on the entry form. Normal installation of windows does not include replacement of jambs, sills, or casing. In the event the winner of the contest has purchased and fully paid for windows from K&H during 2006, the winner may elect to receive an alternate prize of 1½ times the total purchase price paid according to the winner’s contract, up to a maximum amount of $9,000. In the event the winner of the contest purchased and had windows from a company other than K&H installed within 2 years prior the date of the drawing, the winner will have the choice of replacing those windows with windows from K&H or relinquishing the prize to an alternate winner, who will be selected by another random drawing. The winner may substitute six replacement windows for a bay window or a garden window, or three replacement windows for a patio door.
5. All sweepstakes entries must be received at K&H at its office no later than 11:59 p.m. on December 31, 2006 MST. One winner from among all sweepstakes entrants will be chosen by random drawing conducted by K&H between January 1, 2007, and March 31, 2007. The actual date of the drawing will be K&H’s discretion. The winner will be notified by method determined by K&H. The winner must take delivery of the prize within six months of being notified by K&H, or all rights to that prize are deemed forfeited. In that case, the prize will be awarded to an alternate winner, who will be selected by another random drawing conducted by K&H on a date selected by K&H.
6. If applicable, only one alternate drawing will be held, after which the prize will remain unawarded. All entries become the exclusive property of K&H and will not be acknowledged or returned.
7. Each household can only enter the sweepstakes one time per calendar year. There can only be one entry per email address. If more than one person from a household enters the sweepstakes more than one time per calendar year, all of that household’s entries shall be null and void. If there is more than one entry from an email address, all entries from that email address shall be null and void. K&H is not responsible for lost, late, misdirected, incomplete, or inaccurate entries, or from any technical failures or problems, including but not limited to malfunctions of telephones, computers, network, hardware, software, or other equipment or items.
8. All entrants agree that: (a) all disputes, claims and causes of action arising out of or connected with this sweepstakes shall be resolved individually and without resort to class action in binding arbitration held in Denver, Colorado, pursuant to the commercial arbitration rules of the American Arbitration Association, then in effect; (b) no arbitration award shall include, and the entrant waives all rights to claim, punitive, consequential, incidental damages, attorney fees, and the right to have damages multiplied or increased; and (c) the laws of the State of Colorado shall apply, regardless of any choice of laws provisions of the State of Colorado.
9. Only homeowners may qualify for this giveaway. Each household can only win this sweepstakes once, regardless of in which year a member of that household previously won the sweepstakes. Only homeowners living in areas where K&H does business are eligible. The determination of what constitutes those areas shall be made by K&H. Prior customers of K&H who have purchased windows from K&H must have fully and timely performed all provisions of their contract with K&H in order to be eligible to enter this promotion.
10. All entrants must be 21 years of age or older to enter. Prizes are nontransferable and no substitutions are allowed except as noted above.
11. The winner is liable for all federal, state, and local taxes, if any, and may be required to provide identification, social security number, and proof of age.
12. Except where prohibited, by entering the sweepstakes, the winner irrevocably agrees that K&H may use his/her voice, name and likeness and that of their homes, including participation in photo and/or video session, for promotional and publicity purposes without any additional compensation. Winner must sign and return a release and affidavit of eligibility, which must be received within 7 days of notification. If winner does not timely return the affidavit of eligibility, the prize will be awarded to an alternate winner, who will be selected by another random drawing conducted by K&H.
13. The decision and interpretations of the drawing and rules by K&H will be final and binding.
14. Past and current employees and immediate family members of past and current K&H employees as well as owners and/or officers of companies competing with K&H, and their immediate family members, are not eligible to participate in this contest.
15. Odds of winning depend on the total number of entries.
16. The sponsor of this sweepstakes is K&H Windows and Exteriors. The address of K&H and the address at which K&H may be contacted is 5805 W. 56th Ave., Arvada, CO 80002.
17. K&H reserves the right to disqualify entries from anyone suspected of attempting to disrupt the sweepstakes. K&H may prosecute and/or seek other legal remedies against anyone suspected of engaging in these acts.
18. This contest is void where prohibited, taxed or restricted.
19. The name of the sweepstakes winner is available by sending a self-addressed stamped envelope prior to December 31, 2007, to K&H, Attn: Winner List, 5805 W. 56th Ave., Arvada, CO 80002.
